1. Introduction

These Terms of Service ("Terms") govern the use of services provided by Foxington LLC ("Foxington", "we", "our", or "us"). By ordering, accessing, or using any of our services, you agree to be bound by these Terms.

Services include but are not limited to:

  • Web hosting

  • VPS hosting

  • Dedicated server hosting

  • Game server hosting

  • Domain-related services

  • Website development

  • Technical support and consulting


2. Eligibility

You must be at least 18 years old or have the consent of a legal guardian to use our services.


3. Account Registration

Customers must:

  • Provide accurate and complete information

  • Keep account credentials secure

  • Notify us immediately of unauthorized access

  • Maintain a valid email address for billing and support notices

You are responsible for all activity occurring under your account.


4. Acceptable Use

You may not use our services to:

  • Distribute malware, ransomware, or malicious code

  • Conduct phishing, fraud, or identity theft

  • Host or distribute illegal content under South African law

  • Send unsolicited bulk email (spam)

  • Launch or participate in DDoS attacks

  • Infringe copyright, trademark, or other intellectual property rights

  • Exploit our infrastructure in a manner that negatively affects other customers

We reserve the right to suspend or terminate services that violate this policy.


5. Resource Usage

Shared resources must be used reasonably. Excessive CPU, RAM, disk I/O, or network usage that affects service stability may result in:

  1. Temporary throttling

  2. Suspension pending investigation

  3. Upgrade recommendations

  4. Termination for repeated abuse


6. Payments and Billing

6.1 Billing Cycle

Services are billed monthly, quarterly, annually, or as otherwise specified.

6.2 Due Dates

Invoices are due on the date shown on the invoice.

6.3 Late Payments

If payment is not received by the due date:

  • Services may be suspended after 3 days

  • Services may be terminated after 14 days

  • Data may be deleted after termination

6.4 Refunds

Unless otherwise stated:

  • Domain registrations are non-refundable

  • Custom development work is non-refundable once work has commenced

  • Hosting services may qualify for a 7-day limited refund for first-time customers, excluding abuse or policy violations


7. Backups

Customers are responsible for maintaining their own backups. While Foxington may perform courtesy backups, we do not guarantee the availability, accuracy, or restoration of backups.


8. Service Suspension and Termination

We may suspend or terminate services for:

  • Non-payment

  • Abuse complaints

  • Security threats

  • Legal requirements

  • Violations of these Terms

Termination does not waive any outstanding fees owed to Foxington.


9. Intellectual Property

Customers retain ownership of their content. You grant Foxington a limited license to store and transmit content solely for the purpose of providing the services.

Foxington retains ownership of:

  • Our software

  • Branding and logos

  • Website design

  • Documentation and proprietary systems


10. Limitation of Liability

To the maximum extent permitted by South African law, Foxington shall not be liable for:

  • Loss of profits

  • Loss of business opportunities

  • Data loss

  • Indirect or consequential damages

  • Service interruptions caused by third-party providers, power failures, or force majeure events

Our total liability shall not exceed the amount paid by the customer for the affected service during the three (3) months preceding the claim.


11. Indemnity

You agree to indemnify and hold Foxington harmless from any claims, damages, or expenses arising from:

  • Your use of the services

  • Your content

  • Your violation of these Terms

  • Your violation of any applicable law


12. Force Majeure

Foxington is not liable for failure or delay caused by events beyond our reasonable control, including:

  • Power outages

  • Fibre or network failures

  • Natural disasters

  • Civil unrest

  • Government actions

  • Cyberattacks against upstream providers


13. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.


14. Changes to These Terms

We may update these Terms from time to time. Continued use of the services after changes become effective constitutes acceptance of the revised Terms.
